Candidate Employment Terms and Conditions
These terms and conditions govern your employment with MC Labour Services Pty Ltd, MC Traffic Management Pty Ltd, MC Security Services Pty Ltd, MCLS (Aust) Pty Ltd, MC Height Safety Pty Ltd and MC Maritime Services Pty Ltd and any Related Entities (The “Employer”) as a Casual Employee and the Employer’s allocation of assignments (the “Assignments”) to you to perform work for clients (the “Clients”) of the Employer.

By agreeing to participate in the recruitment process, you hereby confirm:
1. Terms and Conditions of Employment
- Your casual employment will be subject to an applicable National Modern Award (“MA”), National Employment Standards (“NES”), other employment related legislation, and/or MC Enterprise Agreements (“EA”):
- will be conditional on the assignment(s) you are required to perform
- any termination of employment will be as per the applicable employment instrument
2. Payment of Wages
- Your wages have been calculated for hours worked and are therefore paid in full satisfaction of all monetary entitlements under any applicable Awards, EA’s, including weekly wages, allowances, overtime and penalty rates and any applicable award loading to the extent that the excess covers such applicable

- you completing and submitting the Employer’s timesheet authorised by the Client in respect of each relevant

3. Allocation of Assignments (“Jobs”)
- Where the Client instructs you to perform work different from, in addition to the position or at a different site to that described in the original assignment, you must notify the Employer
- The Employer is in the business of recruiting candidates to perform tasks for the Employer and/or its Clients as required by those Clients and is under no obligation to provide suitable or ongoing work for any particular candidate.
- You will be employed by the Employer on a casual basis, dependent on provisions of the appropriate employment instrument for as long as a Client requires you to perform work for that Client and not otherwise. Each casual engagement is on a standalone basis as per the minimum requirements of engagement as contained within the appropriate employment
- You acknowledge that an Assignment is provided on a casual and temporary basis only and, unless otherwise confirmed in writing by the Employer only, no action by the Employer or the Client shall constitute an offer of future permanent, contract or temporary
- The Employer may in its absolute discretion offer an Assignment to the candidate of its choice, notwithstanding that some candidates may consider themselves to have special expertise in a particular
- You are under no obligation to accept the offer of an Assignment. Once such assignment is accepted, either by commencing an Assignment or signing this Agreement (whichever is the earlier), your casual temporary employment pursuant to the terms of this Agreement will
- You must comply with all relevant Employer and Client policies and procedures, including those in relation to occupational health and safety (as amended from time to time).

- On each occasion you have been rostered to work, the minimum daily hours of work will be subject to the Award/EA you fall under.
4. Australian Work Rights
- To be considered for an Assignment, it is necessary you are either
- an Australian or a New Zealand citizen; or
- an Australian permanent resident; or
- in possession of a valid and appropriate working
- If you are an Australian citizen, you must provide proof of your citizenship prior to commencement of employment, being certified copies a passport (bio-data page), birth certificate and photo identification or citizen certificate (including certificate of evidence of citizenship).
- If you are a New Zealand citizen, you must provide proof of your citizenship prior to commencement of employment, being certified copy of your New Zealand passport identification (biodata)
- If you are an Australian permanent resident, you must provide proof of your resident status prior to commencement of employment, being certified copies of your passport identification (bio-data) and a copy of your visa label (from your passport) or certificate of evidence of resident status (which can be obtained from the Department of Immigration).
- If you are not an Australian or a New Zealand citizen, or an Australian permanent resident, then you must provide the following proof of your Australian work rights prior to commencement of employment, being certified copies of the following documents:
- your passport identification (biodata) page; and your current Australian visa label from your passport; and
- all Australian Immigration entry and exit stamps in your passport (not required for spousal visas).
- All the certified documents required under subclauses (b), (c), (d) and (e) above must be given to the Employer with this signed
- If you hold an Australian visa, you must comply with all the terms of the visa; otherwise, the Employer will take immediate steps to terminate your employment without notice or pay in lieu of
- Medical Insurance: You must be compliant with your VISA conditions including but not limited to you having and maintain overseas visitor hospital and medical insurance and provide proof of such insurances to the Employer upon commencement of the assignment and each financial year during the term of the original or any subsequent Assignment
